Dear Mayor and members of the Greenport Village Board,

I am writing to express concern regarding the village’s current parking signage and its compliance with New York state law.

Under New York Vehicle and Traffic Law § 1683(a)(8), parking restrictions are not enforceable unless signs or markings providing adequate notice of those restrictions are posted. When a parking restriction applies only during specific hours or seasonal periods, those hours and dates must be clearly displayed directly below the “Pay to Park” sign to provide the legally required notice.

Additionally, New York has adopted the National Manual on Uniform Traffic Control Devices, or MUTCD, as its official standard for traffic control devices. The MUTCD requires that regulatory signs clearly communicate the specific conditions under which restrictions apply. Omitting hours or seasonal dates fails to provide motorists with adequate notice and calls enforceability into question.

This letter addresses only the issue of missing operating hours and seasonal information. It does not address several additional concerns regarding the current signage, including the absence of directional arrows where required, compliance with height requirements, and compliance with the 200-foot placement standard.

I respectfully request that the village review the current parking signage for compliance with applicable state law and MUTCD standards and take prompt corrective action.
